Image Usage Policy for TEC Clients
Dear Client,
As part of TEC’s commitment to providing premium branding services, we use licensed images through our Standard License with Shutterstock. TEC will not be responsible if you fail to comply with this Image Usage Policy, and use of any images provided by TEC is subject to strict compliance with these terms. To ensure compliance with Shutterstock’s licensing terms and to protect both your business and ours, the following guidelines apply to the use of these images:
1. Usage Rights
- The images incorporated into the deliverables provided by TEC, including but not limited to websites, marketing materials, and advertisements, are licensed under TEC’s Shutterstock Standard License.
- You are permitted to use these images only within the scope of the final deliverables provided by TEC.
2. Independent Use of Images
- You are not permitted to use the images independently of the deliverables provided by TEC. If you wish to make changes to any deliverable that incorporates a Shutterstock image, these changes must be completed only by TEC.
- If you require independent use of any images or need to make alterations without TEC’s involvement, you must obtain a separate license directly from Shutterstock. TEC’s Standard License does not extend to standalone usage of the images by clients.
- TEC will not provide raw image files to clients, in accordance with Shutterstock’s licensing terms, to prevent unauthorized or improper use.
3. Prohibited Uses
- Images may not be used in any manner that is defamatory, derogatory, or otherwise unlawful, including but not limited to use in pornographic content, political endorsements, or campaigns promoting illegal substances.
- Images may not be used as part of a trademark, service mark, or logo without obtaining an exclusive license from Shutterstock.
- Further limitations on the use of Shutterstock Images may be found here.
4. Editorial Images
- TEC does not generally have access to editorial images through Shutterstock, as these are intended for use in newsworthy contexts and not for commercial purposes.
- However, some editorial images may be available for commercial use through Shutterstock’s Asset Assurance program, which provides indemnification in the event of legal claims regarding the use of the images. If you wish to use editorial images in a commercial context, please contact TEC in advance, to confirm that the images are covered by this program and can be used safely for your intended purpose.
5. License Types
- Standard License: Covers common uses such as websites, social media posts, and print advertisements with distribution limits of up to 500,000 copies.
- Enhanced License: Required for uses beyond the scope of the Standard License, including but not limited to merchandise, unlimited print distributions, or products for resale. More details about licensing can be found here.
6. Liability
- TEC is not responsible for any misuse of Shutterstock images by clients. It is the client’s responsibility to ensure compliance with all licensing terms.
- By adhering to these guidelines, you help protect both your business and ours from potential legal issues.
If you have any questions, please do not hesitate to contact us.
Thank you for your cooperation.
Sincerely,
The TEC Team
